Terms of use
Translation for convenience. In case of discrepancy, the Spanish version prevails.
1. Acceptance #
These terms govern access to and use of inversionesbucardozuniga.cl (the "Site"), owned by INVERSIONES BUCARDO ZUNIGA LIMITADA, RUT 78.123.772-8, with its address at (the "Holding"). By using the Site you accept these terms. If you do not agree, do not use it. If you use the Site on behalf of an organisation, you represent that you are authorised to bind it. These terms supplement the Legal notice; in the event of conflict regarding the absence of any securities offering, the Legal notice prevails.
2. Purpose of the Site #
The Site is institutional and informational. It presents the Holding, its principles and the companies in which it holds interests, and offers contact channels. It does not offer products, services, securities or investments, and is not a channel for payments or transactions. See the Legal notice.
3. Permitted use #
You may browse the Site and use its forms for lawful, good-faith purposes. You agree not to:
- (a) use the Site or its name to impersonate the Holding, its founding partners, staff or group companies, or to simulate a relationship with them;
- (b) submit false information, third-party data without authorisation, or unlawful, defamatory, discriminatory or infringing content;
- (c) send unsolicited advertising, chain messages or bulk content through the forms;
- (d) introduce viruses, malicious code or loads affecting the Site's availability;
- (e) extract content by automated means (scraping, unauthorised crawling), except search-engine indexing in accordance with
robots.txt; - (f) attempt to bypass security measures, access restricted areas, the database or third-party accounts, or test vulnerabilities outside the responsible disclosure policy;
- (g) use the Site in breach of applicable law, including economic sanctions and export control laws.
We may block submissions or access that breach these terms and, where appropriate, inform the authorities.
4. Information you submit #
4.1. You are responsible for the accuracy and lawfulness of what you submit and for having authorisation to share third-party data.
4.2. No confidentiality or exclusivity. Submitting a message, presentation or idea creates no contract, duty of confidentiality (other than the legal protection of personal data), exclusivity, or obligation to respond, invest or compensate. Do not submit confidential information or trade secrets. Any confidentiality obligation will exist only if agreed in writing and signed by an authorised representative of the Holding.
4.3. The Holding may independently know of, develop or invest in projects similar to yours. Your submission does not restrict that freedom.
4.4. You retain your rights in the content you submit. You grant the Holding a non-exclusive, royalty-free, limited licence to store and use it internally solely to handle and respond to your request, in accordance with the Privacy policy.
5. Intellectual property #
As set out in section 6 of the Legal notice.
6. Availability #
The Site is provided "as is" and "as available". We may modify, suspend or discontinue the Site or any part of it at any time without notice or liability.
7. Limitation of liability #
To the fullest extent permitted by law, the Holding is not liable for indirect damages, loss of profits, lost opportunities or loss of data arising from use of the Site or reliance on its content. This limitation does not apply to wilful misconduct or gross negligence or to non-waivable statutory rights.
8. Indemnity #
You will hold the Holding harmless from third-party claims arising from your wilful or negligent breach of these terms or the law, including infringement of third-party rights through information you submit.
9. Third-party sites #
Links to group company or third-party sites are governed by section 7 of the Legal notice.
10. Changes #
We may amend these terms. The version in force is the one published on this page. Continued use of the Site after publication constitutes acceptance of the new version.
11. Severability and language #
If any clause is held invalid, the remaining clauses remain in force. These terms are published in Spanish and English; the Spanish version prevails in case of discrepancy.
12. Governing law and jurisdiction #
These terms are governed by the laws of the Republic of Chile. Any dispute shall be submitted to the ordinary courts sitting in the commune of Santiago, without prejudice to non-waivable rights under the law of the user's domicile.
